E1 Visa
Treaty Trader
- Treaty Trader Visa – limited to specific countries.

- These visas require 50% ownership by a foreign person who must be from the country list.
- Keep in mind that places like India and China DO NOT have a treaty with the USA so people from these countries cannot use the E visa.
E2 Visa
Investor/Owner
- Treaty Investor Visa -limited to specific countries.
- Country List – https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/fees/treaty.html.
- These visas require 50% ownership by a foreign person who must be from the country list.
- Keep in mind that places like India and China DO NOT have a treaty with the USA so people from these countries cannot use the E visa.
Most often these visas come from three types of cases:
- Major companies like Toyota – they can prove they are foreign owned based upon the stock market and they then can send employees to the USA.
- Individuals who already own a business and want to start a new one in the USA.
- Individuals with wealth who use the visa to move to the USA by buying or starting a business.
